Who is a “producer”?

Under SB 582, a “producer” is determined in the following order of responsibility:

  1. 1Brand owner of the product sold in packaging in OR
  2. 2Licensee who sells under another's brand
  3. 3Importer of record for sale in OR
  4. 4Person who first distributes the item in or into OR

Flat Fee Option

Optional tiered flat fee for low-volume producers. Producers with gross revenue < $10M supplying > 5 metric tons, or vice versa, may choose flat fees instead of per-pound rates. Available to producers over $10M revenue for the bottom two tiers only.

When does the flat fee save money? At 2.5 metric tons (~5,500 lbs) with an average rate of $0.25/lb, per-pound fees would be ~$1,375 — but the flat fee is only $1,200, saving ~$175. Producers with mostly paper/fiber packaging (low per-lb rates) may pay less per-pound than the flat fee.
