Who is a “producer”?
Under SB 582, a “producer” is determined in the following order of responsibility:
- 1Brand owner of the product sold in packaging in OR
- 2Licensee who sells under another's brand
- 3Importer of record for sale in OR
- 4Person who first distributes the item in or into OR

Optional tiered flat fee for low-volume producers supplying ≤10 metric tons into Oregon. Graduated by supplied tonnage; does not vary by material category. Flat fees adjust with the annual budget. Tiers below 5 metric tons are also available to producers with over $10 million in gross revenues.

When does the flat fee save money? At 2.5 metric tons (~5,500 lbs) with an average 2027 rate of $0.15/lb, per-pound fees would be ~$825 — the flat fee is $700, saving ~$125. Producers with glass, aluminum cans, or printed paper (near-$0 rates) pay less per-pound than the flat fee.
Eco-Modulation Factors
Credits (reduce fees)
Reductions are factored into fees based on environmental performance and impact. Qualifying activities: increasing PCR content, reusable packaging, moving to lower-impact materials.
Maluses (increase fees)
Sustainable Infrastructure Modification — $0 for 2026; for 2027, $3 million in previously collected SIM fees is being returned to producers along with ~$80M in reserves
